General Conditions of Sale - ITSARA

1. Acceptance

The acceptance of these general conditions of sale is materialized by the click of validation of the order. This electronic signature has the same value as a handwritten signature. It implies that the customer acknowledges having read and accepted all these conditions.


2. Products

The photographs present on the Itsara.net site aim to describe the articles with the greatest fidelity. However, due to the artisanal nature of the creations, slight variations may exist from one jewel to another. These photographs have no contractual value.

ITSARA reserves the right to withdraw or add products at any time.


3. Availability and deadlines

All the products offered are available unless otherwise indicated ("Add" button gray).

The indicative delivery times are:

  • 1 to 6 working days for mainland France

  • 4 to 7 working days for Europe

Price in mainland France:

    • Home 3/5 days: € 3.90 - (up to € 39 of purchase)
    • 3J relay point: € 4.60 - Offered from 90 € of purchase
    • Colissimo Home 3J: € 5.40
    • Colissimo domicile with 3J signature: € 6.10 

    EU:

    Home - 4 to 6 working days - € 4.60 (€ 79.99 purchase maximum)

  • Deliveries in the European Union:
    We deliver in most countries of the European Union.
    Delivery times vary depending on the destination and are detailed on our dedicated page.
    The right of withdrawal, the legal guarantee of compliance and the return policy also apply to European customers, in accordance with the regulations in force.

In the event of a stock error, we will offer you an equivalent item or will make a refund.

Delivery delays can in no case give rise to the cancellation of the order or requests for damages.

The order is validated upon receipt of payment. A confirmation is sent by email.

The information transmitted by the customer when ordering engages it. In the event of an error in the contact details, Itsara cannot be held responsible for the impossibility of delivering the order.

👉 The customer can request any change before the package of packages in our premises.


5. Payment

Payment is made upon order, in euros. The means of payment accepted: bank card. Via the integrated system, Payplug or Scalapay for payment in three times at no cost. 

In the event of refusal of payment by the banking establishment, the order is automatically canceled.


6. Price

All prices are displayed in euros including tax.

For orders delivered outside the European Union, customs duties and import taxes may be required by local authorities, payable by the customer.

Sales in the European Union: Prices include the VAT applicable according to the country of delivery, in accordance with the OSS single window regime.
For countries outside the EU or subject to customs duties (eg Swiss), sales are made excluding taxes. Possible customs costs are the responsibility of the recipient.


7. Delivery

Delivery is ensured by the carrier chosen when ordering. In the event of proven loss (verified via the follow -up number), we proceed to a surrender or a refund.

In the event of a dispute (parcel indicated as delivered but disputed), a declaration on honor and proof of identity and domicile may be requested.


8. Right of withdrawal

In accordance with Articles L221-18 to L221-28 of the Consumer Code, you have a 14 -day withdrawal right From the receipt of your order, without having to justify a reason or to pay penalties.

👉 ITSARA gives you an extended period of 30 days to make a return (excluding specific cases below).

The products must be returned in perfect condition, not worn, with their original packaging. The incomplete, damaged, soiled or manifestly worn returns will not be exchanged or reimbursed.

The reimbursement will take place within a maximum of 14 days from receipt of the return. Itsara undertakes, in fact, to treat it within 3 working days.


9. Returns, exchanges and reimbursements

🌀 A free return is offered by order, in mainland France, provided it is not a second exchange For the same order or the same article. The return request is made via the customer account.

The jewelry must be returned with care. Any article presenting traces of wear or alteration making its return to sale impossible will be excluded from the reimbursement.

💶 A return package of € 4 can be applied in the following cases:

- Article ended at -30 % or more
Second return For the same order or the same article (size or model), unless an additional article is added as part of this second exchange
- Order less than 90 € having benefited from a Exceptional free delivery
Error of size validated despite our preliminary recommendations or exchanges (email, telephone, WhatsApp)


10. Legal guarantee

All our jewelry benefit from the legal guarantee of 2 -year compliance (items L217-3 to L217-20 the consumer code) and the guarantee against hidden defects (items 1641 to 1649 of the Civil Code).

The warranty covers manufacturing defects making the jewelry unfit for normal use.

It does not cover:

  • Natural wear and tear

  • Shocks, clashes, scratches

  • Misuse or poor maintenance

  • Any modification or repair made by a third party

Good use protects your jewelry and extends their lifespan.
Our jewelry is designed to be worn on a daily basis. You can keep them in the shower or during hand washing, without worry. They will only be more beautiful.
However, they can alter themselves in the event of repeated friction, shock, or excessive manipulation (large torsion, forcing, etc.).

For adjustable rings and bracelets, the adaptation must remain minimal and punctual. A slight resistance is normal at each pass.
The hooks or rods of the earrings should also be manipulated gently: fold them excessively or repeated can cause fragility or deformations.

11. Responsibility

Itsara cannot be held responsible if the legislation of the country of delivery prohibits certain products. It is up to the customer to inquire with the local authorities.

ITSARA's responsibility is limited to the amount of the order in the event of error, delay or impossibility of treatment.


12. Personal data

ITSARA collects and processes customer data in accordance with General Data Protection Regulations (GDPR).

These GTCs are governed by the French law.

In the event of a dispute, an amicable solution will always be privileged. The customer can enter Free consumer mediator or any competent body. In case of failure, Only French courts will be competent.

These general conditions are governed by French law.
In the event of an order placed from a country of the European Union, the consumer also benefits, if necessary, the imperative rights provided for by the legislation of his country of residence (in accordance with the Rome I regulation).
For countries outside the European Union (such as Switzerland), French law applies, unless otherwise stated with local law.
